Sometimes when documents are submitted for recording they need to be rejected. This can happen for a number of reasons. In this article, we are going to walk through some of the most common reasons that documents are rejected and how to avoid these errors when recording title.
Incomplete Notary Acknowledgement
Perhaps the most common error we see is that the notary acknowledgement is incomplete. Perhaps a stamp is forgotten, or the paragraph itself has not been completed correctly. It may be blank or it may be inconsistent with the language above in the signature block or in the document itself.
Missing Statutory Requirements
A second reason documents can be rejected is if the statutory requirements are missing. One that is frequently missed is the drafted by language. If you are drafting a document that may be submitted for recording it’s always important to include the name and address of the drafter of the document.
All of these can delay the time it takes to get to documents recorded and to memorialize your interest in a piece of real estate.
