Halloween is in the air, and while you may enjoy rewatching A Nightmare on Elm Street, nobody wants their next commercial transaction to turn into a nightmare. Unfortunately, title issues cause problems for commercial buyers all the time. In today’s blog we share some tips for preventing five scary title concerns.
-
Long Lost Heirs - You need to make sure that a title is clear by investigating it during the due diligence stage of the sale. If a long-long heir has a right to the property or another party is named on the deed, the seller you’re working with may not have the true authority to move forward with the sale. This can cause major issues if the rightful owner eventually comes forward.
-
Scary Scammers - Sometimes scammers will impersonate a seller or try to get you to transfer money to them using fake listings or wiring instructions. Know who you’re dealing with, and be wary of individuals who won’t meet in person or talk to you over the phone. Working with a tried and true title services company can add another layer of protection, as we’ll work to vet all parties involved in the transaction.
-
Spooky Liens - You and your title services team will investigate the property during the due diligence stage to discover the existence of any liens against the property. Unpaid property taxes, mechanic’s liens and even outstanding Homeowner’s Association fees can lead to a lien being placed on the property. These liens stay with the property, not the individual who incurred them, so if you close on a property with outstanding liens, that debt may become yours to deal with. Let us make sure no unresolved liens exist before you close.
-
Zombie Easements - An easement agreement is a deal between parties that allows one party to access another person’s property for a specific purpose. These easements typically remain in place even if property is sold, so you need to ensure you are aware of any easements that allow others to access the property you’re considering buying. Much like a zombie, these easement agreements are tough to kill, as you’ll need permission from all involved parties, and there’s not much you can do if one party wants to keep a previous easement agreement in place. We’ll uncover any easements associated with the property before you close.
-
Ghosted Agents - Finally, don’t deal with realtors or title service agents who are going to ghost you or take days to return your calls and texts. At Commercial Partners, we pride ourselves on our communication and we’ll keep you updated every step of the way. We want to make this process as simple as possible for you, while others are just here to collect a paycheck. Don’t get ghosted by other industry professionals, work with a team you can trust by calling Commercial Partners at (612) 337-2470.
